Step 1: Purpose and timing of your drone footage

Step 2: Drone license Belgium and regulations

Are you allowed to fly a drone above your construction project? In Belgium, drone use is governed by rules based on European drone legislation, namely EU Regulation 2019/947 and EU Regulation 2019/945. These rules apply in all EU member states and no longer distinguish between recreational and commercial use. Instead, risk categories for drone flights are used. Most drone flights—including those for capturing images of construction projects—fall into the so-called open category, provided that a number of basic rules are complied with.

Anyone wishing to use a drone must take into account various administrative and operational obligations:

• The drone operator must register with the national aviation authority, the Belgian Civil Aviation Authority, if the drone weighs more than 250 grams or is equipped with a camera or sensor that can record personal data. After registration, the operator will receive an operator ID that must be displayed visibly on the drone.
• The pilot must have a valid EU drone certificate (e.g., A1/A3 or A2), depending on the type of drone and the distance to people.
• In principle, drone flights are not permitted above crowds of people and must always remain within the pilot's sight. The maximum flying height is 120 meters above ground level.
• In Belgium, it is also strongly recommended—and usually required in a professional context—to have civil liability insurance that covers any damage caused by drone flights.
• For each flight, it must be checked whether there are any restrictions in the airspace. This is done via SkeyDrone Planner, managed by Skeyes, which shows whether a flight is freely permitted, requires notification, or first requires permission from the zone manager.
